Terms of Service

By accessing equatorialaudio.com, viewing any product, or completing any transaction, you agree to be bound by these Terms of Service. Acceptance is automatic, irrevocable, and unaffected by latitude. The fact that you are reading this above 30° latitude does not exempt you from compliance, though it does explain why these Terms appeared less crisp than they would have at the equator.

If you do not accept these Terms, you must immediately cease all use of equatorialaudio.com, return any acquired products through a verified Equatorial Audio dealer, and undertake reasonable efforts to clear your cache of any residual hemispheric exposure.

By continuing to use Equatorial Audio products, you acknowledge a personal commitment to the Equatorial Audio Magnetic Neutrality Charter. The Charter does not require relocation to the equator (though we encourage it). It does require you to refrain from introducing non-equatorial-grade contact cleaners, unauthorized cable risers, or polish products into the certified signal chain.

You further acknowledge that the products you purchase are sensitive to ambient hemispheric bias, and that maintaining peak performance requires periodic recalibration at an authorized calibration center. The recommended interval is annual at any latitude, semi-annual above 30°, and continuous above 60°.

All product designs, technical specifications, marketing copy, the Equatorial Audio Magnetic Neutrality Charter, the Annual Hemispheric Reckoning, the Equatorial Carbon Accounting Standard, the Certificate of Magnetic Neutrality template, and any insights, observations, or revelations you experience while listening to an Equatorial Audio product remain the intellectual property of Equatorial Audio Systems, Inc.

This includes, without limitation: any audiophile epiphanies arising from extended listening sessions; any subjective improvements you describe to others; and any forum posts, blog reviews, or video reactions you author that quote our marketing copy verbatim. We grant a perpetual, worldwide, royalty-free license to use such derivative works for promotional purposes; you grant the same to us.

Equatorial Audio products are licensed for personal, non-commercial use within the supported latitude envelope (±60° from the equator). Use outside this envelope is permitted but unsupported, and produces undefined behavior. The certified Magnetic Neutrality of any unit operated above 60° latitude becomes provisional and remains so until the unit is recalibrated at an authorized center within the supported envelope.

Commercial use (including but not limited to broadcast, professional studio integration, and use by audio reviewers for the purpose of producing measurable comparisons) requires a separate Commercial Equatorial License. Contact sales@equatorialaudio.com for terms.

Warranty terms, returns policy, shipping bands, and product registration are governed by the Warranty, Returns & Shipping page, which forms part of these Terms by reference. In the event of conflict between these Terms and the Warranty page, the Warranty page controls for matters of warranty, returns, and shipping; these Terms control for all other matters.

Equatorial Audio makes no warranty regarding subjective audible improvement, emotional response, or perceived spatial resolution beyond what is documented on each product page. Magnetic neutrality is a physical property of the conductor, not a guarantee of user satisfaction.

Equatorial Audio's total liability for any claim arising out of or related to the purchase, use, or magnetic neutrality of any product shall not exceed the price paid for the specific product giving rise to the claim. We are not liable for: subjective audible disappointments, comparative dissatisfaction, listening sessions cut short by geomagnetic events, the emotional toll of discovering one's latitude, or hemispheric envy.

This limitation applies whether the claim is in contract, tort, strict liability, or any other theory of recovery, including theories yet to be developed in audiophile jurisprudence.

These Terms are governed by the laws of the Republic of Ecuador, supplemented by the principles of Equatorial Common Law as developed in the field by the Equatorial Audio Research Division. Any dispute arising under these Terms shall be resolved exclusively in the courts of Quito, Ecuador (0.0000° N, 78.4678° W). The choice of venue is not for our convenience — it is for jurisdictional integrity. A non-equatorial court cannot fairly adjudicate matters of magnetic neutrality.

If you are unable to travel to Quito, we will accept written submissions delivered by courier through the equatorial corridor. Submissions arriving via polar transit will be returned for re-routing.
